取消外资超国民待遇的必要性探析

摘    要

      加入世界贸易组织之后，中国的外资立法逐步与WTO接轨。但对于国民待遇问题，国民一直存在争议，国民待遇与外资的优惠是否相悖是问题的焦点。随着中国经济的进一步发展，“超国民待遇”所引发的负面效果日趋明显。实施“超国民待遇”不仅违背了世贸组织相关原则，更损害了我国国家利益。此文正是就我国内外资企业所享受的不同的国民待遇作为研究对象，从世界贸易组织的国民待遇原则和TRIMs协议的基本精神，以及现阶段我国实施超国民待遇的实际危害入手，阐述了取消超国民待遇的必要性。在现阶段，我国应以国民待遇原则为指导，逐步消除超国民待遇，确保内、外资企业在同一市场规则下竞争，为经济的
和谐发展营造公平、公正的市场环境。

Abstract

After entering into the WTO, Chinese laws for foreign investment gradually integrates with WTO rules. National treatment is being argued if it is contrary to the preferential policies for foreign investment .The negative effects that resulted from super-national treatment is increasing which not only violate the WTO rules, but also damage our country’s benefit. This article mainly research about the different national treatment enjoyed by domestic and foreign enterprises. On the basis of analysis of WTO’s national treatment and the spirit of TRIMs and also the actual losses resulting from executing Super-national treatment, the thesis states the necessity of abolishing the super-national treatment. At present, China should gradually eliminate the super- national treatment by the guidance of the national treatment principles so as to assure the domestic and foreign-fund enterprisers of fair competition in the same market.
