博客网络版权存在的法律问题及对策

摘  要

     博客是一种满足“五零”条件(零编辑、零技术、零体制、零成本、零形式)的全新的并且力量强大的网络交流工具。最近几年发展特别迅速,引起了人们的广泛注意。然而随着博客网站的发展, 仅是博客作品的网络版权保护问题, 就因一起起博客网络版权侵权案而展开了热烈的讨论。
本文主要讲述了博客网络版权存在的法律问题，并在分析问题的基础上提出了相应的解决方法。首先在分析国内外博客网络版权研究现状的基础上，对博客的定义、特征、作用和目前发展现状等基本情况进行概述，使人对博客有个初步的认识；其次详细的分析了博客网络版权在立法、执法和司法三方面存在的法律问题；再次在对这些问题进行初步剖析的基础上，提出相应的解决方案；最后对博客网络版权的未来发展与完善进行展望与预测。

Abstract

Blog is a brand-new and powerful network exchange tool, which satisfies five qualifications (No edition, No technology, No system, No cost, No form). The blog has proliferated and developed rapidly in recent years, and has attracted widespread attention. However，with the development of blog-website, the protection of its network copyright has launched a warm discussion after several cases of the damages of the network copyright of blog.
  This paper mainly elaborates the legal problems of blog’s network copyright and proposes the corresponding solutions to settle these problems. First, it discussess the basic situations of the blog, such as the definition, the characteristics, the function, the present situation and the legal status and so on in order to enable the person to have an preliminary understanding on the basic of the present research situation home and abroad. Second, it details the legal problems of blog network copyright in legislation, law-enforcement and judicature. Third, on the basis of the analyses of these problems it gives the ways to settle the problems. Finally it forecasts the development and improvement of the blog’s network copyright in future.
