网络游戏中的财产纠纷问题探析

摘    要

    随着互联网的普及和网络游戏业的快速发展，新兴的社会现象产生了——网络游戏虚拟财产。由于立法的滞后，网络游戏虚拟财产的纠纷解决上存在很多问题。因此，研究网络游戏虚拟财产，不仅在理论上，对传统民法中的物权、债权、知识产权等理论在互联网时代的运用上有所补充，而且在司法实践上，也对解决网络游戏虚拟财产纠纷有着重要的意义。
本文着重研究了国内网络游戏中虚拟财产的纠纷问题及其相应的对策。首先，文章分别介绍了网络游戏虚拟财产的概念、特点、法律属性；其次，对目前国内一些常见纠纷形式进行了分析，随后又根据我国当前的实际情况与世界上其他国家所采取的措施针对本文提出了几点主要的建议；最后文章对未来网络游戏虚拟财产相关问题的完善解决抱有美好的展望。

Abstract

With the rapid development of internet and online games, a new term called virtual properties of online games appeard. There are many problems in disputes because of the lag of legislation. Doing some researches can not only add supplements to the traditional law theoris applied to the internet, but also mean significance in solving the disputes.
This paper studies the domestic disputes of the virtual properties of online games, as well as presents the issues raised in the corresponding solution. Firstly, the article introduces the concept of the virtual properties of online games, characteristics and law attributes; Secondly, some present situations for the domestic disputes are analyzed and some problems are presented. In accordance with the present realities of the world, other countries have taken measures to address some of the main recommendations of this paper; Finally, the paper holds the belief that virtual properties of online games will have promising future.
