中国国际商事仲裁制度的发展和适用

摘  要

 本研究在深入分析中国国际商事仲裁制度的发展过程和取得成就基础上，分析中国仲裁制度目前存在的不足，主要表现在：忽视关于国际商事仲裁的法律适用方面的立法；与涉外仲裁的国际性要求还有差距；仲裁协议形式要件的要求过于严格；缺乏关于临时仲裁的规定。在此基础上认真进行了对中国国际商事仲裁协议的法律适用、中国国际商事仲裁程序问题的法律适用以及中国国际商事仲裁实体问题的法律适用立法及实践进行评析。在此基础上，对完善我国《仲裁法》提出若干建议。包括：完善关于国际商事仲裁的法律适用方面的立法；对于仲裁协议效力的形式要件做宽松的认定；规定并承认临时仲裁的效力。

The Development and Application of the International Commercial Arbitration Legal System in China

ABSTRACT

 The author analyzed the development and the achievements of the international commercial arbitration legal system in China, and pointed out its defect, such as neglecting the applicable law, maintaining gap to the requirements of international arbitration, the formal requirements being too strict, and lack of interim arbitration provisions. The author then reviewed the applicable law of arbitration agreement and the procedure question and the material question. It the last part, the author brought out some suggestion to the arbitration law, including consummating the legislation on applicable law, recognizing effectiveness of the arbitration agreement on a low standard, stipulating the ad hoc arbitration system.
