婚姻关系中妇女权益的保护

摘要：在最近几十年里，人权已成为国际社会的热点问题。对于人权的界说，当前国内外学界其实不同一，议论纷纷。单一地讲，人权就是在必然的社会历史条件下每一个人按其本体和尊严享有和理当享有的权利。跟着人权的生长，近几年来女性人权也备受存眷。为什么"人权”概念提出后又单独提出"妇女人权”?因为，从历史上看，在相当长的时间内，妇女权利不被看作人权的范畴。所谓女性的人权，便是指妇女成为"女性”的人所享有和理当享有的权益。

妇女人权包含了两个方面：一是妇女与男子平等，在“人”和男人享有平等权利。二是以女性的生理特性为基础，以人的生殖任务为女性，独特的。妇女的权利已经成为当今社会研究的一个热门话题，许多学者从不同的角度妇女权利的研究。根据颁布的，近年来，研究当今女子婚姻家庭权益的保护问题，新的“婚姻法”的观点。纵观妇女的权利和利益的发展过程中，我们发现，在新的“婚姻法”的权利和妇女的婚姻的利益和家庭的保护下比过去有很大的进步，但由于种种原因，新在妇女的婚姻家庭权益保护“婚姻法”有一些缺点。为此，我们研究它的进步，探索它的局限性，分析原因，尝试提出加强妇女的婚姻家庭权益保障措施，以进一步妇女权利和婚姻家庭问题的利益提供一定的了解启示。

而《婚姻法》对婚姻关系也有一定的规定和划分，要定义婚姻关系主要是要满足以下几个方面。一、结婚的主体是男女两性法。像不是由男女两性生理差别的结合，便不构成结婚法。二、结婚行为是法律行为法。像申请结婚的双方当事人必须遵守法律的规定，履行法律规定的程序，否则，婚姻关系不产生法律后果，即：不受法律保护的无效婚姻法。三、结婚行为的法律后果是，确立双方的夫妻关系，并承担由此而产生的责任、权利、义务法。像这种已确立的夫妻关系，未经法律程序，任何单位、个人或夫妻双方都无权解除夫妻关系法。本文主要是研究婚姻关系内的妇女权益的保障，即在婚姻关系中的女性的合法权益如何受到保障和维护。

ABSTRACT：In recent decades, human rights have become a hot issue of international concern. Simply put, human rights is in a certain social and historical conditions of each individual according to their nature and enjoy the dignity and rights should enjoy that as human rights and should enjoy. With the development of human rights, women's human rights is also of concern in recent years. Why "human rights" concept was put forward after issue separate "women's rights"? Because, historically, for a long time, women's rights are not considered human rights category. The so-called human rights of women, the rights of women as a means "woman" who enjoyed and should enjoy. 

 The women's rights contains two aspects: First, the rights of women as equal to men, "who" enjoy equality with men: two physiological characteristics of women rights and human reproduction tasks undertaken as a woman and that is based on the unique. For example, women during menstruation, pregnancy, childbirth and other lactation should enjoy special rights.In this paper, in recent years, the new "Marriage Law" enacted into perspective, today's women to study the guarantee of the rights of marriage and family. Overview of the development process of women's rights, we find in the New "Marriage Law" under the protection of marriage and family rights and interests of women today than in the past has been great progress, but for various reasons, making the new "marriage" to protect women's rights in marriage and family there are many aspects of insufficient. To this end, we study its progressive nature, explore its limitations, analyze the reasons, trying to put forward countermeasures to strengthen women's rights protection of marriage and family, provide some inspiration for the further understanding of the rights of women families marital problems.
