浅论我国体育仲裁制度的构建

摘    要

      体育仲裁制度是一种行之有效体育纠纷解决方式，在体育纠纷解决领域中发挥着重要功能，为世界大部分国家和地区所采用。但反观我国的体育纠纷解决领域，体育仲裁立法单薄、体育仲裁实践空白，这种体育法制建设相对滞后的状况如果不能得到彻底的改变，必将成为影响和制约我国体育事业未来发展的重要因素。本文将以体育仲裁的根源——体育纠纷作为切入点，把我国现今的我国的体育纠纷解决机制作为支点，从我国构建体育仲裁制度的必要性，可行性，应遵循的原则，法律依据，仲裁机构，仲裁程序等方面论述我国体育仲裁制度的构建。我国体育仲裁机制的构建应注意其专业性，要有专门的仲裁机构，专门的仲裁规则，专业的仲裁人员，仲裁范围的确定应符合其专业要求。

ABSTRACT

Sports arbitration system is an effective way to resolve sports disputes, resolve disputes in the field of sports play an important function, most of the world's countries and regions adopted. But the other hand, China's sports dispute resolution  areas, few of Arbitration for Sport Council, the practice of Arbitration for Sport blank, this sport has lagged behind the building of the legal system can not be complete if the situation changes, and will certainly become a constraining influence  the future development of China's sports undertaking a major factor. This paper  will be the source of Arbitration for Sport as the entry point for sports disputes, China's present-day China's sports dispute resolution mechanism as a fulcrum, from the Construction of China's system of Arbitration for Sport the necessity, feasibility, should follow the principle of a legal basis for arbitration Agencies, and other aspects of the arbitration proceedings on China's Construction of the system of Arbitration for Sport. China's sports arbitration mechanism should pay attention to the construction of its professional, a special arbitration bodies, specialized arbitration   rules of professional arbitrators, should determine the scope of arbitration in line  with their professional requirements.
