无单放货的法律地位及其发展趋势

摘  要
  
 无单放货一直是航运实务中一个不可避免的问题。由于关于海运的三大公约及我国海商法对无单放货的规定过于笼统，导致无单放货问题一直充满争议。本文对无单放货的法律地位及相关的法律问题作了具体的分析。并结合有关《鹿特丹规则》以及我国最新的司法解释对无单放货法律地位的发展趋势进行探究。 《鹿特丹规则》允许一定程序下的无单放货，是处理这一问题的一大创举，我国司法解释对无单放货的规定也更加全面细致。由此也可以看出对无单放货进行系统的立法将对航运业产生积极的影响。

Abstract

    Delivery goods without bill of lading has always been an unavoidable problem in international shipping practice. Since the regulations of delivery goods in conventions about international shipping and Chinese maritime law are too ambiguous, this problem is full of controversy. This article do some specific analysis for the Legal Status of delivery goods without bill of lading and some other relevant legal question. Furthermore, the article make a thorough inquiry for the development tendency of delivery of goods without bill of lading’s Legal Status combine with 《Rotterdam Rules》 and the newest judicial interpretation of our country. The 《Rotterdam Rules》 permit delivery goods without bill of lading under specific condition is a pioneering work for dealing this problem, and the regulations in judicial interpretation of our country are more comprehensive. Thus we can see that the systemic legislation for delivery goods without bill of lading will produce positive influence for shipping industry.
