关于未成年人适用缓刑的探讨

摘   要

青少年是祖国的希望，民族的未来。未成年犯罪人在刚刚步入社会的初期，就遭受牢狱之痛，对未成年人及其家庭影响巨大。因此，应当注重对未成年犯罪人缓刑的适用。本文通过对未成年人适用缓刑的分析，通过梳理相关的文献对未成年缓刑含义进行界定，并对未成年缓刑适用的现状进行分析，找出其中存在的制度种类适用标准以及缓刑监控与政策实施等多个方面的问题，并结合司法实践，提出提出了增设缓刑审前调查制度，扩大未成年适用缓刑条件，取消未成年累犯不适用缓刑的规定以及细化缓刑适用的条件等等，并对全文进行总结。

Abstract

Youth is the hope of the motherland, the future of the nation. The minor crime at the beginning have just stepped into the society, they suffer from pain of imprisonment, of adults and family influence great. Therefore, we should pay attention to minor criminal probation applicable.

In adult probation system in this paper, we study the problem of its application, through combing the literature, this paper investigate minor probation for existing problems, analyzes the types of probation system, discusses the multiple aspects of probation applicable standard and probation supervision and policy implementation, proposed the creation of probation pre-trial investigation system proposed, the author believes that should be expanded to juvenile offenders on probation for criminal law and the other adult penalty is a reference and draw lessons from the meaning of.
