我国夫妻财产制的现状及其完善

摘要

我国婚姻法特别现行的夫妻财产制度方面存在较多的缺点，但是至今仍旧没有形成一套完备的法律体系来保障夫妻之间的财产问题得到完善和解决，无法从根本上体现出我国所处的基本国情。同时就当前我国的司法实践中存在的热点和难点问题而言，我国大部分法律没有对其加以过多的涉及，甚至于对此方面的立法也是比较少的。因此，针对当前我国的夫妻财产制度的立法现状的研究而言，具有一定的现实作用.

Abstract

China's marriage law has many shortcomings in the current marital property system. However, there is still no complete legal system to guarantee the perfection and solution of marital property problems, which cannot fundamentally reflect China's basic national conditions. At the same time, in terms of the hot and difficult problems existing in China's judicial practice, most of China's laws do not involve them too much, and even the legislation on this aspect is relatively rare. Therefore, it is necessary and feasible to study the current legislation of the marital property system in China.
