摘要

当前，社会经济处于一个飞速发展的阶段，尤其是现实中的一些“碰瓷”行为成为一种普遍现象，而且随着现实环境的变化越来越成为一种趋势，表现出一种多样化的趋势，而且对社会的影响也是越来越大。是故，必须要对当前的这种“碰瓷”行为进行一定的法律规定。但是，当前的法律体系中并没有这一相关规定，而且对这一问题也出现了不一的看法。本文首先对交通碰瓷行为的界定、类型以及特点进行了阐述，然后对“碰瓷”行为的罪名进行了适用性分析以及对“碰瓷”行为的司法认定进行了分析，最后对交通“碰瓷”行为之法律完善提出了几点对策。

ABSTRACT

    At present, the social economy is in a stage of rapid development, especially the "pengci" behavior in reality has become a common phenomenon, but also become a trend with the change of the realistic environment more and more, showing a trend of diversification, and the impact on society is also growing. Therefore, must be on the "pengci" behavior to certain legal provisions. However, the current legal system does not have such a relevant provision, and there are different views on this issue. Based on the traffic behavior pengci the definition, types and characteristics are described, and then the "pengci" behavior on the applicability of analysis and the "pengci" behavior of the judicial identification is analyzed, finally puts forward some countermeasures of the legal behavior of traffic "touchporcelain" perfect.
