摘要

目前，网络4G的普遍运用，以出行为例，手机上的网约车APP给老百姓的生活带来方便的同时，也冲击到传统的利益格局，打破了以往特许经营监管模式，尤其是网约车的监管安全与其地位是否合法备受争议。世界各国对网约车路径的监管采取不同的做法，比如新加坡的行政监管方法以注册为基础，美国的行政监管方法是设立专门的网络平台运输公司。如何通过吸收、借鉴国外对于网约车成熟的行政监管经验，解决我国目前网约车面临的诸多问题，创设出符合我国现阶段的网约车的监管办法，既使得受到网约车冲击的传统交通方式的运营者的利益得到保护的同时，部门间的立法冲突又能够得到缓解，找寻到我国网约车适宜的发展模式和监管路径，最终使得网约车能够高效、便捷地服务公众。
