论新形势下国有土地上房屋征收与补偿制度的完善

摘要

2011 年 1 月21日，《国有土地上房屋征收与补偿条例》（以下简称《征收补偿条例》）的颁布实施，标志着“房屋拆迁”为“房屋征收”所取代，政府成为房屋征收的主体，随之而来的问题是与实践相配套的征收程序的亟待完善和相关立法的健全。《征收补偿条例》虽然有了很大的进步，但我国目前的国有土地房屋征收制度仍存在着公共利益缺失、公众参与机制不够完善等问题。因此，为了解决上述问题，应当完善公共利益的界定程序，并对房屋征收过程中的监督制约机制进行配套的立法，以促进公众参与。本文首先对房屋征收拆迁的概念和制度发展演变的过程进行了介绍，总结了《征收补偿条例》的巨大进步，研究了当前制度存在的不足并提出解决对策，通过对房屋征收与补偿中所存在的问题进行系统的分析，寻找参与房屋征收各方利益的平衡点，为房屋征收与补偿的实践提供积极的参考和启示。

Abstract

Therefore, in order to solve the above problems, it is necessary to perfect the procedure of defining the public interest, and to support the legislation of the supervision and restraint mechanism in the process of house collection, so as to promote the public participation. This article first introduces the conception of house demolition and the process of the development and evolution of the system, summarizes the great progress of the "Regulations on Collection and Compensation", studies the shortcomings of the current system and puts forward solutions to these problems. Through housing levy and compensation And find out the balance point of the interests of all parties involved in the housing collection, so as to provide a positive reference and inspiration for the practice of house collection and compensation.
