EPC工程总承包项目常见法律风险与防范

摘要

在项目管理当中，风险管理是一个非常重要的问题，特别是EPC项目，这些风险通常包括政治、经济、市场、业主、合同和自然条件等，其中导致EPC项目的合同法律风险更为重要。EPC项目合同法律风险包括合同条款风险和合同管理风险。合同管理是承包商获利的关键手段，不善于管理合同的承包商是绝对不可能获得理想的经济效益的。因此要注意合同中的工程范围、合同价格及其款项支付方式、保函条件和违约条款等合同内容，并加强合同条款的审核。承包商企业对EPC工程总承包项目通过风险识别、风险分析、风险控制和处理，通过以上各个方面调查研究，分析发生各种风险的可能性及危害程度，对风险做出客观的综合评价，为制定和采取减轻和转移风险的措施提供依据。

Abstract: In project management, risk management is a very important problem, especially in EPC project, these risks are usually include political, economic and natural conditions, market, the owner, contract, etc., which lead to the EPC project contract legal risk is more important. EPC project contract legal risks including the terms of the contract and contract management risks. Contract management is the key to the contractor's profit, are not good at management contract the contractor is absolutely impossible to obtain the ideal economic efficiency. Therefore attention should be paid to the project scope in the contract, the contract price and payment method of payment, letter of guarantee condition and content of the default clause of the contract, and strengthen the terms of the contract review. Contractor enterprise of EPC project general contracting projects through risk identification, risk analysis, risk control and processing, through the above various aspects of investigation and study, analyzed the possibility of various risks and damage degree, comprehensive evaluation of risk is objective, to formulate and provides the basis for risk mitigation and transfer measures.
