论我国的行政赔偿方式

摘要

    赔偿制度对于保护公民、法人和其他组织的合法权益，防腐倡廉、提高行政效率具有重要意义。 我国目前的行政赔偿的方式有支付赔偿金、返还财产、恢复原状，这几种行政赔偿方式各有其适用范围和条件。随着我国社会事业的发展，这几种行政赔偿发式在理论和实践中逐渐暴露出自己的不足和缺陷，与公民对责任政府、法治政府的需求存在一定的矛盾。有鉴于此，本文拟通过我国行政赔偿方式入手进行阐述，着重指出我国行政赔偿方式的不足与缺陷，然后提出一些可操作性的完善措施。

Abstract

  Compansation system has important significance for protect the legal rights,  of citizen, corporation and other organization, combat corruption and build a clean government and increase the administration efficiency. China's current administrative compensation methods have paid compensation, restitution of property, restitution, these methods have their own applicable scopes and conditions. With the development of social undertakings in China, these kinds of administrative compensation styles gradually exposed its shortcomings and defects in theoretically and practically, and the citizens have certain contradiction of government accountability and the rule of law demand. In view of this, this article intends to start by means of administrative compensation in our country, and puts forward some problems and defects of administrative compensation, and then puts forward some measures to improve the operational performance.
