浅析夫妻共同债务问题

摘要

近年来，伴随着我国经济社会的高速发展，家庭财产结构变化巨大，公众的婚姻家庭观念和家庭投资观念也日趋多元化，因经营投资产生的债务风险也随之扩大。司法实践中，夫妻一方与债权人恶意串通损害另一方利益，或夫妻双方串通损害债权人利益的案例时有发生。这些因素叠加在一起，使夫妻债务的识别极为复杂，并且在法庭上审理相关案件的难度增加。目前，需要从立法和司法层面全面规范夫妻共同债务。

本文首先阐述夫妻共同债务制度的基础理论。其次分析了我国夫妻共同债务制度现状，并对我国夫妻共同债务制度存在的问题进行分析，最后结合我国实际情况提出完善我国夫妻共同债务制度的建议。

Abstract

In recent years, along with the rapid development of China's economy and society, the family property structure has changed greatly. The public's concept of marriage and family and the concept of family investment have become increasingly diversified, and the debt risk arising from business investment has also expanded. In judicial practice, a case in which a spouse and a creditor maliciously collude to harm the interests of the other party, or if the spouses collude with the interests of the creditor. These factors are superimposed together so that the identification of the marital debt is extremely complex and the difficulty of hearing related cases in the court increases. At present, that needs to comprehensively regulate the joint debt of husband and wife from both the legislative and judicial levels.

This article first describes the basic theory of the joint debt system of husband and wife. Secondly, it analyzes the current situation of the joint debt system of the husband and wife in China, and analyzes the problems existing in the joint debt system of the husband and wife in China. Finally, it puts forward suggestions on perfecting the joint debt system of the husband and wife in China based on the actual situation in China.
