摘要

随着信用卡的广泛试验,信用卡欺诈已成为一个备受关注的问题,不仅扰乱了信用卡的订单管理,这也阻碍了信用卡行业的稳步发展,严重影响了市场金融的秩序。

信用卡诈骗罪是一种新型犯罪，是一种与传统杂谝罪分开的金融诈骗犯罪。较于传统诈骗罪,其表现形势复杂多样,导致在处理其在司法实践与刑法理论上的问题时有较多的分歧。所谓信用卡诈骗是指使用信用卡作为犯罪的载体，其主要行为是使用假冒伪劣信用卡、使用假身份证欺诈信用卡或者使用其他人的信用卡和恶意透支。

“中华人民共和国刑法”第一百九十六条第一款有规定,信用卡诈骗罪特点应该是以非法占有为目的,为了非法占有，信用卡被用作骗取公共和私人财产的工具。结合刑法理论和司法实践,"以非法占有为目的"应成为信用卡诈骗的必要条件。

本文从信用卡欺诈的概念着手,对信用卡的表现形态、犯罪构成要件以及司法认定中的一些问题进行探讨研究,结合理论与实践对完善信用卡的使用安全提出建议。

Abstract

With the extensive experiment of credit card, credit card fraud has become a problem of great concern, which not only disrupts the order management of credit card, but also hinders the steady development of credit card industry and seriously affects the order of market finance.

Credit card fraud is a new kind of crime, which is a kind of financial fraud crime which is separate from traditional miscellaneous crimes. Compared with the traditional crime of fraud, its performance situation is complex and diverse, which leads to more differences in dealing with its problems in judicial practice and criminal law theory. The so-called credit card fraud refers to the use of credit cards as a carrier of crimes. Its main behavior is to use fake credit cards, use fake identity cards to defraud credit cards, or use other people's credit cards and malicious overdrafts.

Article 196, paragraph 1, of the Criminal Law of the People's Republic of China stipulates that the crime of credit card fraud should be characterized by the purpose of illegal possession. In order to illegally occupy, credit cards are used as tools to defraud public and private property. Combined with criminal law theory and judicial practice, &; Quot; For the purpose of illegal possession & amp; Quot; It should be a necessary condition for credit card fraud.

This paper starts from the concept of credit card fraud, discusses and studies some problems in the form of credit card, the constitution of crime and judicial determination, and puts forward some suggestions to improve the security of credit card use.
